Terms and Conditions (T&C)

Scope

These General Terms and Conditions (T&C) govern the contractual relationship between ForTec e.U. and its customers in the field of special machine construction.

Offer and Contract Conclusion

Our offers in special machine construction are subject to change and non-binding. The contract is only concluded upon receipt of a written order confirmation from ForTec e.U. or the delivery of the special machine.

Service description

The specific services in special machine construction are defined in a written contract or order confirmation from ForTec e.U. This includes technical specifications, delivery times, prices, and payment terms.

The specifications and project scope are documented in the specification sheet, which the customer acknowledges in writing.

Prices and Payment Terms

The prices for our special machines are specified in the order confirmation or written contract. Unless otherwise agreed, prices are exclusive of value-added tax. Payment is made according to the agreed payment terms.

Unless otherwise agreed, 30% of the total amount is due upon order placement, 30% of the total amount at the start of production, and 40% of the total amount upon delivery.

Delivery, Acceptance, and Transfer of Risk

The delivery of the special machine will be carried out according to the agreed delivery conditions. The customer is obliged to promptly inspect the delivered special machine for any defects and notify them in writing. The risk transfers to the customer as soon as the special machine leaves the premises of ForTec e.U.

Warranty

We warrant that our special machines are free from defects and meet the agreed specifications at the time of delivery. In the event of defects, you are entitled to rectification or replacement, provided it is technically possible and economically feasible. Further claims are excluded.

The statutory warranty period prescribed in Austria applies.

Liability

Our liability in connection with our special machines is limited to intent and gross negligence. Further liability, particularly for consequential damages or lost profits, is excluded.

Intellectual Property

All rights to intellectual property, such as patents or copyrights, related to the special machines delivered by us, remain with us. Any use, reproduction, or distribution of our technical documents or designs requires our explicit written consent.

Confidentiality

All information exchanged in connection with our business relationship, marked as confidential or evidently confidential, must be treated as confidential and shall not be disclosed to third parties.

Final Provisions

If individual provisions of these T&C are or become invalid, this shall not affect the validity of the remaining provisions. Austrian law applies. The place of jurisdiction for all disputes arising from the contractual relationship is the Regional Court of Wels.
